Terms & Conditions / FPL Broadcaster League 2024/25
The following terms and conditions (“T&Cs”/ “Terms and Conditions”) are applicable to all interested persons (“Participant(s)”) who are participating in the FPL Broadcaster League (as defined hereinbelow) being organized by FAPL (as defined hereinbelow) and/or through its agency(ies).
1. FPL Broadcaster League: Football Association Premier League Limited, company number 02719699, of Brunel Building, 57 North Wharf Road, London, W2 1HQ (“FAPL”) is the entity which organises the football tournament called ‘Premier League 2024/25’ season (“Premier League”). FAPL also conducts an online fantasy football tournament that is run via the Premier League’s fantasy gaming platform (“Fantasy Game”) which is present on the website and mobile application owned and operated by it. As part of the Fantasy Game, FAPL enables the Participants of the Fantasy Game to automatically join the public leagues available in a particular geographical region. Accordingly, FAPL will be running a separate public league in the Fantasy Game for the territory of India which will be named after the channel of the official broadcaster of the Premier League in India, i.e., Star India Private Limited (“Star”) and will be known as ‘Disney Star League’ (“FPL Broadcaster League”). It is clarified that the FPL Broadcaster League will run in parallel to the other public leagues available for the Fantasy Game for the residents of India.
2. FPL Event Period: The FPL Broadcaster League will begin on 17th August 2024 and will end on 25th May 2025 or the date on which the last round of fixtures of the Premier League are played, whichever is later.
3. Eligibility to enter and eligibility to receive the Prize (as defined hereinbelow):
3.1. Subject to rules 3.3 and 3.4 hereinbelow, all individuals who have registered as a manager in the Fantasy Game, are residing within the territorial limits of India and have selected India as their country/region of residence in the Fantasy Game, will be automatically entered into the FPL Broadcaster League (“Entrant”).
3.2. There is no entry fee involved for participating in the Fantasy Game and/or the FPL Broadcaster League.
3.3. It is agreed that individuals residing outside India, employees/representatives of Star and their relatives may participate in the FPL Broadcaster League. However, such persons shall not be eligible for any Prize.
3.4. If an Entrant is under the age of 18 (eighteen) years (“Minor”), parental or guardian consent must be obtained before that Entrant can claim any Prize. Such consent must include a confirmation that the parent/guardian consented to the Entrant’s Entry to the FPL Broadcaster League, and they consent to the Entrant having the chance to be awarded a Prize.
4. How to enter: Entrants will be automatically entered into the FPL Broadcaster League by the FAPL (an “Entry”). No entrance procedure is required.
4.1. Entrants are only permitted one Entry. Any attempt by an Entrant to obtain more than one Entry by using multiple and/or different accounts, identities, registrations, logins, addresses or through any other methods, may void all of such Entrant’s Entries and such Entrant may be disqualified. Entries generated by script, macro or other automated means and entries by any means which subvert the Entry process are void. Incomplete, illegible and/or corrupt entries will not constitute a valid Entry.
4.2. Any content or portion of an Entry that is, in Star’s or the FAPL’s sole discretion, obscene, profane, lewd, defamatory and/or violates any proprietary right of any person living and/or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) and/or entity, sexual in nature, and/or is otherwise objectionable, will disqualify the Entry as determined in the FAPL’s and/or Star’s sole discretion. Entries must be in keeping with the FAPL’s and Star’s image and may not be offensive, as determined by FAPL or Star in its sole discretion.
5. Format, Rules & Scoring of the FPL Broadcaster League:
5.1. Format & Rules: The format and rules applicable on the public leagues including broadcaster leagues within the Fantasy Game (available at: https://fantasy.premierleague.com/help/rules) will be applicable on the FPL Broadcaster League in addition to these T&Cs.
5.2. Scoring: The scoring of overall points will be determined as per the scoring model prescribed in rules of the Fantasy Game.
6. The Participants shall be bound by and to abide by the terms and conditions of the (available at https://fantasy.premierleague.com/help/terms) (collectively, “Fantasy Game Terms”) in addition to these T&Cs. In the event of any conflict between these T&Cs and the Fantasy Game Terms, these T&Cs shall prevail.
7. In addition to the representation and warranties given under the said Fantasy Game Terms, the individuals participating in the FPL Broadcaster League also represent and warrant that:
7.1. He/she is not on any Specially Designated Nationals and Blocked Persons List issued by the U.S. Treasury Department's Office of Foreign Assets Control.
7.2. He/she will not bring the FPL Broadcaster League, the Fantasy Game, Star, FAPL and/or any of its clubs into disrepute.
8. Drawing of Monthly Winner(s), Season Champion, Cup Winner and Runner-Up: Eligibility for respective Prize will be as follows: (i) Entrant(s) who has/ have scored the highest number of points in the FPL Broadcaster League at the end of the relevant month of the ongoing Premier League season (each a “Monthly Winner”, and collectively, “Monthly Winners”); (ii) the Entrant who has scored the highest number of points in the entire FPL Broadcaster League at the end of the ongoing Premier League season (“Season Champion”); (iii) the Entrant who has the highest points with respect to Cup(s) based on the FAPL’s rules and regulations posted on https://fantasy.premierleague.com/help/rules) (“Cup Winner”) and (iv) the Entrant who has scored the second highest number of points in the FPL Broadcaster League at the end of the ongoing Premier League season (“Runner-up”). However, it is hereby clarified that no Prize shall be awarded to Entrant(s) who has/ have scored second-highest number of points in the FPL Broadcaster League at the end of the relevant month of the Premier League season or with respect to one or more Cup(s). The Monthly Winner(s), the Season Champion and the Cup Winner are hereinafter collectively referred to as “Winner(s)”. The exact timing of when the FAPL select the Winner(s) and Runner-Up and award the Prize is at the sole discretion of the FAPL. Further, if the Winner(s) and/or Runner-Up fails to provide the information requested from him/her pursuant to rule 11.4 hereinbelow, subject to rule 11.1 hereinbelow, within 20 (twenty) days from the date on which such information has been requested and/or gets disqualified for any other reason whatsoever, then Star shall have the sole and absolute discretion to retain/ distribute the Prize in the manner it may deem fit.
9. Tie: In the event that two or more Entrants have the same number of points in the FPL Broadcaster League at the end of that month, the Prize will be awarded to the Entrant whose team was first to be registered on the FAPL website at www.premierleague.com. The FAPL and/or Star’s decision in this regard will be final and binding; and no correspondence will be entered into, in this regard.
10. Prize:
10.1. The details of various categories of the Prize are as follows:
(i) For Monthly Winner(s): 1 (one) Premier League bundle;
(ii) For the Season Champion: 1 (one) Premier League bundle;
(iii) For Cup Winner: 1 (one) Premier League merchandise item; and
(iv) Runner-up: 1 (one) Premier League merchandise item.
10.2. Star may, at its sole discretion, decide to award a Prize to the Winner(s) of each month during the course of the ongoing Premier League season.
10.3. The Prize is subject to availability and Star, in its sole discretion, reserves the right to later amend, substitute or withdraw either the entire Prize or any element (including the criteria set for winning a Prize) of it. The Prize (and each component thereof) is non-transferable and non-exchangeable and no cash alternative will be offered in any circumstance. Star will not be responsible to accommodate any requests made by the Winner(s)/ Runner-Up in relation to the Prize.
10.4. If the Winner or a Runner-Up refuses to accept the Prize, Star shall be released and absolved from all obligations or liabilities (if any) towards such Winner(s) or Runner-Up in connection to the Prize or otherwise. Any and all taxes and/or levies applicable under the laws of India and any incidental costs direct and/or indirect, in relation to Prize shall be solely borne and paid by the respective Winner(s) / Runner-Up (as the case may be).
11. Winner(s) and Runner-Up Notification:
11.1. The Winner(s) and Runner-Up will be notified by FAPL via email, as stated in their account used to play the Fantasy Game, within 5 (five) days of points calibration for the relevant month/ season. The FAPL will provide the Winner(s) and Runner-Up with Star’s email address on which the Winner(s) and Runner-Up should write to claim the Prize within the timelines and with details as may be prescribed in such email.
11.2. The Winner(s) / Runner-Up will be announced by Star either over its social media handles or any other mode as deemed fit by Star or FAPL at its sole discretion pursuant to completion of the verification formalities.
11.3. Neither Star nor FAPL shall be responsible for any loss of Prize for the Winner(s) or Runner-Up on account of such individual(s) sharing incorrect/ inaccurate details including email address while registering for the Fantasy Game.
11.4. Star will request such Winner(s)/ Runner-Up to provide the following information in terms of rule 8 hereinabove:
(i) their name;
(ii) their address in India for receipt of the Prize;
(iii) proof of residency in India;
(iv) a copy of government issued ID as proof in support of each of the above items;
(v) their contact number; and
(vi) signed confirmation that they are not employees (and/ or consultants and/or persons hired on contract and/or the members of their immediate family) of FAPL, Star and/or their respective subsidiaries, divisions, affiliates, advertising and/or promotional agencies.
11.5. In case the Winner(s) / Runner-Up is/are Minor, Star and/or FAPL may reach out to their respective parent(s)/guardian(s) for further confirmations/ consents as may be required.
12. General Rules:
12.1. If a Winner / Runner-Up and/or individual participating in the FPL Broadcaster League is uncooperative, disruptive, and/or may and/or does cause damage to person, property, or the reputation of Star, FAPL, the Fantasy Game, any FAPL club and/or otherwise violates the policies of Star, then Star/FAPL has the right, in its absolute discretion, to disqualify a Winner/Runner-Up/individual participating in the FPL Broadcaster League without compensation. Each Winner/Runner-Up/individual participating in the FPL Broadcaster League will remain solely responsible for all taxes and other expenses related to the Prize, if any.
12.2. The Participant agrees to follow all directions, rules and regulations framed or given by FAPL and/or Star from time to time.
12.3. Star’s decision on all matters related to gratification including Prize shall be final, override the Fantasy Game Terms as well as FAPL and be binding upon the Participant / Entrant.
12.4. All information provided by Star in connection with the FPL Broadcaster League is provided “as-is” without warranty of any kind (including with respect to authenticity of information). Star and/or its affiliates, and their respective officers, directors, employees, advisors, contractors and agents, partners and third-party associates (collectively, “Star Parties”) make no representations and disclaim all express, implied, and statutory warranties of any kind to the Participant(s) and/or any third party including, without limitation, warranties as to accuracy, timelines, completeness, or fitness for any particular purpose.
12.5. In the event of any aspect of the Prize is cancelled or postponed due to circumstances beyond Star’s control, including but not limited to, travel cancellations, delays and/or interruptions due to acts of God, acts and advice of Governments, acts of war, epidemic, pandemic, natural disasters, weather, acts of terrorism, national catastrophes, advice against any travel and/or movement by any Government and/or official authority for any reason (including by way of example only and without limitation by reason of any actual or potential terrorist threat) and/or the World Health Organisation and/or any internationally recognised medical authority for any reason and/or an event of force majeure, FAPL and/or its representatives and/or Star, Star Parties, and/or its representatives will not be responsible and that portion of the Prize will not be awarded and no additional compensation will be provided. Any and all state and/or local income and other taxes on the Prize is each Winner’s/ Runner’s-Up sole and absolute responsibility.
12.6. The Winner(s) / Runner-Up specifically consent that the personal information of the Winner(s) / Runner-Up including their name, contact number, address and other details, as applicable, shall be transferred by Star or its agency/administrator to a third-party vendor engaged by Star for the purpose of production, sourcing and distribution of the Prize.
12.7. Neither FAPL nor Star and/or its representatives shall be liable or responsible for errors in the administration or fulfilment of the FPL Broadcaster League including without limitation mechanical, technical human, printing, distribution or production errors. Star shall be ultimately responsible for determining eligibility of Winner(s) / Runner-Up for the purposes of Prize/gratification, in their sole discretion. In the event of any breach by an individual of these T&Cs and/or the Fantasy Game Terms, Star reserves the right in its sole discretion to not award any Prize to the said individual/Participant from the FPL Broadcaster League.
12.8. Each Winner / Runner-Up assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this FPL Broadcaster League or use or redemption of the Prize. Notwithstanding anything contained in these T&Cs, neither FAPL nor Star will accept any liability to any individual participating in the Event for any of the following types of loss which an individual/ Entrant / Participant may suffer as a result of their Entry:
(i) loss which was not foreseeable to the said individual/ Entrant / Participant and/or Star when he/she first entered the FPL Broadcaster League (even if that loss results from Star’s failure to comply with these T&Cs or its negligence);
(ii) any business loss an Entrant / Participant may suffer, including loss of revenue, profits, or anticipated savings (whether those losses are the direct or indirect result of Star’s default);
(iii) loss which an Entrant / Participant suffers other than as a result of Star’s failure to comply with these terms and conditions (to the extent such terms and conditions are applicable to Star) and Star’s negligence or breach of statutory duty (to the extent such negligence and/or breach is attributable to Star); and/or
(iv) losses that are indirect, consequential, special, exemplary or punitive.
12.9. It is clarified that the FAPL shall not be responsible or liable for any reason whatsoever including technical disruption, failure and/or any other difficulties, due to which the Winner(s)/ Runner-Up is unable to
12.10. After dispatch of a Prize to a Winner / Runner-Up, in case any loss and/or damage is caused to or incurred by the Prize(s) during transit or otherwise, Star and/or Star parties shall not be liable for any such loss and/or damage. Neither FAPL nor Star shall have any liability towards the individuals for mental and/or emotional trauma and/or disappointment incurred or suffered by him/her in any manner whatsoever including as a result of entering the FPL Broadcaster League or accepting a Prize. In the event of any fault, misunderstanding or dispute concerning any part of the Prize the decision of Star shall be final and binding.
12.11. Every Prize provided is on an ‘as-is where-is basis’ without assurances or warranties of any kind. Star does not provide any assurances or guarantees regarding the Prizes, including quality, merchantability or fitness for purpose. Neither FAPL nor Star shall be liable for any delays, defects and/or failures in any notifications, the Prizes or the FPL Broadcaster League in general.
12.12. Neither party shall exclude its liability for any harm caused to any individual including death or personal injury arising from: (i) its negligence (to the extent such negligence is attributable to Star); and/or (ii) the fact that Star deliberately lied to individuals participating before an Entry was submitted (to the extent such lie is attributable to Star).
12.13. In the event of any breach by an individual participating in the FPL Broadcaster League of these T&Cs and/or the Fantasy Game Terms, Star reserves the right to refuse issuance of Prize to the relevant individual and any other additional recourse as may be necessary.
12.14. These T&Cs may be amended, modified, revised and/or new conditions may be imposed by Star, at any time, including but not limited to, for the purpose of complying with applicable law.
12.15. Applicable law and jurisdiction: All matters related to gratification of the Winner(s)/ Runner-Up of FPL Broadcaster League and these T&Cs shall be governed by and construed in accordance with the laws of India and the parties (i.e., FAPL, Star, Entrant, Participant, Winner(s), etc.) agree to submit to the exclusive jurisdiction of the courts of New Delhi, India.
