1. PRIZE DRAW: The Premier League Matchday Fan Experience Survey Prize Draw (the “Prize Draw”) is an online prize draw, run via the survey platform and sponsored by the Football Association Premier League Limited, company number 02719699, of Brunel Building, 57 North Wharf Road, London, W2 1HQ (“Sponsor”). Yonder Consulting Limited company number 4153928, of Northburgh House, 10 Northburgh Street, London EC1V 0AT (“Administrator”), will administer the Prize Draw.
2. PRIZE DRAW PERIOD. The Prize Draw begin at: 09:00 GMT on 17 October 2023 and end at 23:59 GMT on 02 January 2024 (“Prize Draw Period).
3. ELIGIBILITY. The Prize Draw is open to legal residents of the United Kingdom, who are eighteen (18) years of age or older as of date of entry (“Entrant”). Employees of the Sponsor and Administrator and each of their respective subsidiaries, divisions, affiliates, advertising and promotional agencies and the immediate family members of each (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate or win. The Prize Draw and Entrants are subject to all applicable local laws. There is no entry fee and no purchase is necessary to enter the Prize Draw.
4. HOW TO ENTER. To enter the Prize Draw, during the Prize Draw Period an Entrant must submit their name and email address to the dedicated Prize Draw page after completing the Fan Engagement Survey (“Entry”). Entrants should also confirm acceptance of these terms and conditions, by ticking the ‘opt in’ tick box.
5. An Entry can be submitted at any time during the Prize Draw Period. Entrants are only permitted to submit a maximum of one Entry. Any attempt by an Entrant to obtain more than one Entry by using multiple/different accounts, identities, registrations, logins, addresses or through any other methods, may void all of that Entrant’s Entries and that Entrant may be disqualified. Entries generated by script, macro or other automated means and entries by any means which subvert the Entry process are void. Incomplete, illegible or corrupt entries will not constitute a valid Entry.
6. The Sponsor and the Administrator reserve the right to disqualify any Entry which is, or any portion of that Entry which is, inappropriate, promotional, derogatory, obscene, profane, lewd, defamatory or violates any proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, sexual in nature, or is otherwise objectionable, as determined in the Sponsor’s or the Administrator’s sole discretion. Entries must be in keeping with the Sponsor’s image and may not be offensive, as determined in the Sponsor’s or the Administrator’s sole discretion.
7. Upon submission, all Entries become the sole property of the Sponsor and will not be returned and once submitted, can only be withdrawn in writing to the Sponsor.
8. DRAWING THE WINNER.Twelve (12) prize winners ("Winner") will be selected in a random drawing, which will take place within four (4) weeks of the expiry of the Prize Draw Period, from all eligible Entries. The random drawing will be conducted by the Administrator. The Administrator's decision is final on all matters relating to the selection and/or judging of the Prize Draw. The odds of winning the prize will depend on the number of eligible Entries received throughout the Prize Draw Period.
9. THE PRIZE. To the extent that is reasonably practicable and possible, as determined solely by the Sponsor and the Administrator, each Winner will receive one (1) prize only from the following possible options: either (i) a pair of tickets to attend a Premier League match during the 2023/2024 Season, or (ii) an EA SPORTS™ FC24game, or (iii) a replica shirt, or (iv) any other prize at the Sponsor’s sole discretion (the “Prize”). Should the Winner receive a pair of tickets, this will be for a fixture of the Sponsor’s sole discretion. The Sponsor will make reasonable efforts to ensure the match features a Premier League Club of the Winner’s preference however the Sponsor shall not be obliged to accommodate any requested made by a Winner in relation to the Prize.
10. The Prize is subject to availability and eligibility and the Sponsor reserves the right to later amend, substitute or withdraw any element. If a Winner is not able to demonstrate their compliance with the eligibility requirements set out herein, or is disqualified for any other reason whatsoever at the sole discretion of the PL or the Administrator, the Sponsor and the Administrator, each at their sole discretion, reserve the right to withdraw the Prize or any element of it, and the Administrator reserves the right to select a new Winner in accordance with these terms and conditions. The Prize (and each component) is non-transferable and non-exchangeable and no cash alternative will be offered in any circumstance.
11. If the Prize is a pair of tickets to attend a Premier League match during the 2023/24 Season then those tickets must be used by the Winner on the dates specified by the Sponsor surrounding the match or the Prize will be forfeited, and the Sponsor reserves the right to select an alternative Winner in accordance with these terms and conditions. The Sponsor shall not be responsible for any missed, cancelled or delayed transportation used in conjunction with the Prize and no refund or compensation will be provided. All fees and expenses related to acceptance and use of the Prize (such as security fees, gratuities, luggage fees, meals, room service, ground transportation, incidental charges, etc.) are the sole responsibility of the Winner.
12. WINNER NOTIFICATION. The Winner will be notified via email, as stated in their Entry, within one (1) month of the draw taking place in accordance with point 8. The Winner will be required to respond to the email within seven (7) days of receipt of the email. If the Winner fails to respond within this time, their Winner status may be forfeited, and the Sponsor reserves the right to select a new Winner in accordance with these terms and conditions. The Winner is subject to verification by the Sponsor and the Sponsor and/or Administrator may request any reasonable documentation or proof of eligibility.
13. GENERAL RULES. If the Winner is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor or otherwise violates the policies of the Sponsor, and in such a case, the Sponsor has the right, in its absolute discretion, to disqualify the Winner from travel without compensation. The Winner will remain solely responsible for all taxes and other expenses related to the Prize, if any. The Winner may be subject to screening by the relevant Premier League Club based on conditions of entry to the Club’s stadium and the Sponsor shall not be liable should a Winner be refused entry because they fail to meet such conditions. The Sponsor and the applicable Club reserve the right to remove or to deny Entry to any Winner who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the match. The Winner must attend the match themselves. The unauthorised sale or disposal of tickets is a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006.
14. In the event the match, or any other aspect of the Prize, is cancelled or postponed due to circumstances beyond Sponsor’s control, including but not limited to, travel cancellations, delays or interruptions due to acts of God, acts and advice of Governments, acts of war, death of a Monarch, epidemic, pandemic, natural disasters, weather, acts of terrorism, national catastrophes, advice against any travel by any Government or official authority for any reason (including by way of example only and without limitation by reason of any actual or potential terrorist threat) and/or the World Health Organisation or any internationally recognised medical authority for any reason or an event of force majeure, the Sponsor and its agencies will not be responsible and that portion of the Prize will not be awarded and no additional compensation will be provided. Seat selection at the match is subject to availability. No refunds or credit for changes are allowed. Any and all state and/or local income and other taxes on the prize is the Winner’s sole responsibility.
15. All information and personal data shall be controlled by the Sponsor in accordance with its privacy policy which can be found at https://www.premierleague.com/privacy-policy. To the extent that any information contained within an Entry constituting personal data (as defined in the UK GDPR) is disclosed in relation to the Prize Draw, the Sponsor shall ensure that they and all their agents observe the requirements of the Data Protection Act 2018 and UK GDPR (and any amendments, schedules or revisions thereto) and shall protect the security, privacy and integrity of the personal data and personal data shall only be processed in accordance with these terms and conditions or the instructions of the Sponsor. The Sponsor shall use the information in the Entry for the purposes of administering the Prize Draw only and no personal data shall be used for direct marketing, nor will any personal data be passed on to any third parties.
16. By submitting an Entry, the Winner grants to the Sponsor a royalty-free, non-exclusive, perpetual licence to edit, publish, translate, modify, adapt, make available and distribute any element of their Entry throughout the world in any media now known or hereafter invented. For the avoidance of doubt, the Sponsor may make use of the Winner’s entry, their proper name and country of residence online and in print, or in any other media, in connection with the Prize Draw, without payment or compensation, except where prohibited by law.
17. The Sponsor shall not be liable or responsible for errors in the administration or fulfilment of the Prize Draw, including without limitation mechanical, technical human, printing, distribution or production errors. The Sponsor shall be ultimately responsible for determining eligibility for the Prize Draw, in its sole discretion.
18. Each Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Prize Draw or use or redemption of a Prize. For the avoidance of doubt, the Sponsor cannot accept any liability to any Entrant for any of the following types of loss which an Entrant may suffer as a result of their Entry:
a. loss which was not foreseeable to an Entrant and the Sponsor when the Entrant first entered any of the Prize Draw (even if that loss results from the Sponsor’s failure to comply with these terms and conditions or its negligence);
b. any business loss an Entrant may suffer, including loss of revenue, profits, or anticipated savings (whether those losses are the direct or indirect result of the Sponsor’s default); or
c. loss which an Entrant suffers other than as a result of the Sponsor’s failure to comply with these terms and conditions (or any typographical or other error contained herein) and the Sponsor’s negligence or breach of statutory duty.
19. Nothing in these terms will limit the Sponsor’s liability for death or personal injury arising from its negligence or if the Sponsor deliberately lied to Entrants before an Entry was submitted.
20. In the event of any breach by an Entrant of these terms and conditions, the Sponsor reserves the right to:
a. refuse entry into the Prize Draw; or
b. disqualify from the Prize Draw.
21. APPLICABLE LAWS AND JURISDICTION. This Prize Draw and these terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
22. ANNOUNCEMENT OF WINNER. The PL reserves the right to share confirmation of the Winners on its social media platforms in due course once the Winner has formally accepted the Prize. Any request for further information should be made to the Administrator. Parent/guardian consent is required prior to any such announcement relating to a Winner under the age of eighteen (18).
