1. PRIZE DRAW:

a. The Adobe Express Creative Moment of the Month Prize Draw is an online prize draw (the “Prize Draw”), run via the PL’s website, app and social media channels sponsored by the Football Association Premier League Limited, company number 02719699, of Brunel Building, 57 North Wharf Road, London, W2 1HQ (“PL”). Adobe Systems Software Ireland Limited (the "Administrator") will be responsible for the fulfilment of the Prize.

b. The Prize Draw will run each month in line with the information set out on: premierleague.com/en/adobe-hub/adobe-creative-moment (“Dedicated Prize Draw Page”), with each monthly iteration constituting a separate Prize Draw governed by these terms and conditions, subject to any amendments notified by the PL in respect of the applicable Prize Draw Period, Prize or other details.

c. These terms and conditions shall be construed alongside any other terms and conditions brought to the Entrant's attention during their participation in the Prize Draw, including (without limitation) the Creative Moment of the Month Rules made available by the Administrator at https://www.adobe.com/uk/creativecloud/roc/premierleague/tc.html (“Adobe Express Rules”).

2. PRIZE DRAW PERIOD. The Prize Draw begins and ends on the dates specified on the [Dedicated Prize Draw Page] for each iteration of the Prize Draw (the “Prize Draw Period”).

3. ELIGIBILITY. The Prize Draw is open to entrants who are aged eighteen (18) and above and who have submitted an Entry (defined below) (“Entrant”). Employees of the PL and the Administrator and each of their respective subsidiaries, divisions, affiliates, advertising and promotional agencies and the immediate family members of each (spouse, parents, siblings and children) and household members of each such employee are not eligible to participate or win the Prize Draw. The Prize Draw and Entrants are subject to all applicable local laws. There is no entry fee and no purchase is necessary to enter the Prize Draw.

4. HOW TO ENTER. To enter the Prize Draw, during the Prize Draw Period an Entrant must (a) create original content using Adobe Express in accordance with the rules set out on the Dedicated Prize Draw Page and the Adobe Express Rules; and (b) share such content on their own social media channel(s) tagging both the PL and Adobe’s official social media accounts and including the hashtag specific on the Dedicated Prize Draw Page (each an “Entry”). Failure to comply with any of the foregoing requirements shall invalidate the Entry. Entrants who submit an Entry must also confirm acceptance of these Terms and Conditions, by ticketing the ‘opt-in’ tick box.

5. An Entry can be submitted at any time during a Prize Draw Period. Entrants are permitted to submit a maximum of one (1) Entry per Prize Draw. Any attempt by an Entrant to obtain more than one (1) Entry by using multiple/different accounts, identities, registrations, logins, addresses or through any other methods, may void all of that Entrant’s Entries and that Entrant may be disqualified. For the avoidance of doubt, an Entry which does not include the correct tagging of both the PL's and the Administrator’s official social media accounts, or which does not include the specified hashtag, shall not constitute a valid Entry.  For the avoidance of doubt, an Entry which does not comply with the rules set out on the Dedicated Prize Draw Page shall not constitute a valid Entry. Entries generated by script, macro or other automated means and entries by any means which subvert the Entry process are void. Incomplete, illegible or corrupt entries will not constitute a valid Entry.

6. The PL and the Administrator reserve the right to disqualify any Entry which is, or a portion of it is, inappropriate, promotional, obscene, profane, lewd, derogatory, defamatory or violates any proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, sexual in nature, or is otherwise objectionable, as determined in the PL’s or the Administrator’s sole discretion. Entries must be in keeping with the PL’s image and may not be offensive, as determined by the PL or the Administrator in its sole discretion.

7. DRAWING THE WINNER. There will be an opportunity for one (1) Entrant to be selected as a winner of the Prize Draw. The Winner will be selected in a completely random drawing conducted in accordance with the laws of chance from all eligible Entries, which will take place within ninety-six (96) hours of the end of the Prize Draw Period (each a “Winner”). The Winner will be informed ninety-six (96) hours after the random draw takes place. The Administrator’s decision is final on all matters relating to the selection of the Winner. The odds of winning the Prize Draw will depend on the number of eligible Entries received throughout the Prize Draw Period.

8. THE PRIZE. To the extent that it is reasonably practicable and possible, as determined solely by the PL and the Administrator, each Winner will receive the prize specific on the Dedicated Prize Draw Page for the applicable Prize Draw Period. The Prize shall be fulfilled by Administrator. The PL shall not be responsible for the fulfilment or delivery of the Prize. The Administrator shall not be obliged to accommodate any requests made by a Winner in relation to the Prize.

9. The Prize is subject to availability and eligibility and the PL reserves the right to later amend, substitute or withdraw any element. If the Winner is not able to demonstrate their compliance with the eligibility requirements set out herein, or is disqualified for any other reason whatsoever at the sole discretion of the PL or the Administrator, the PL and the Administrator, at their sole discretion, reserve the right to withdraw the Prize or any element of it, and the Administrator reserves the right to select a new Winner in accordance with these terms and conditions. The Prize is non-transferable and non-exchangeable, and no cash alternative will be offered in any circumstance.

10. WINNER NOTIFICATION. The Winner will be notified via email or direct message within ninety-six (96) hours of the Administrator selecting their Entry as the Winner. The Administrator shall make a maximum of three (3) attempts to contact a Winner within ninety-six (96) hours of first notifying the Winner and reserves the right to contact the Winner via their social media accounts. By participating in the Prize Draw, you agree to the PL contacting you in this way. The Winner will be required to respond to the notification within forty-eight (48) hours of receipt of the initial notification by the Administrator. If a Winner fails to respond within this time, their Winner status may be forfeited, and the Administrator reserves the right to select a new Winner in accordance with these terms and conditions. The Winner is subject to verification by the PL and/or Administrator, and the PL and/or Administrator may request any reasonable documentation or proof of eligibility including valid proof of age.  Upon verification, the Winner will be required to provide their full name, delivery address and, where applicable, their favourite Premier League club, in order to facilitate fulfilment of the Prize by Adobe. By providing such information, the Winner consents to the sharing of such details with Adobe solely for the purposes of Prize fulfilment.

11. Winners must be over the age of eighteen (18) to receive the Prize. Any Entry by an individual who is under the age of eighteen will not constitute a valid Entry, and such Winner shall forfeit their winner status and the Administrator reserves the right to select a new Winner in accordance with these terms and conditions.

12. If any aspect of the Prize, is affected, amended, cancelled or postponed due to circumstances beyond PL or the Administrator’s control, including but not limited to, travel cancellations, delays or interruptions due to acts of God, acts and advice of Governments, acts of war, epidemic, pandemic, natural disasters, weather, acts of terrorism, national catastrophes, advice against any travel by any Government or official authority for any reason (including by way of example only and without limitation by reason of any actual or potential terrorist threat) and/or the World Health Organisation or any internationally recognised medical authority for any reason or an event of force majeure, the PL, the Administrator and its agencies will not be responsible and the Prize will not be awarded and no additional compensation will be provided. No refunds or credit for changes are allowed. Any and all state and/or local income and other taxes on the Prize is the Winner’s sole responsibility.

13. All information and personal data shall be controlled by the PL in accordance with its privacy policy which can be found at https://www.premierleague.com/privacy-policy. To the extent that any information contained within an Entry constitutes personal data (as defined in UK GDPR) is disclosed in relation to the Prize Draw, the PL shall ensure that they and all their agents observe the requirements of UK GDPR and the Data Protection Act 2018 (and any amendments, schedules or revisions thereto) and shall protect the security, privacy and integrity of the personal data and personal data shall only be processed in accordance with these Terms and Conditions or the instructions of the PL. The PL shall use the information in the applicable Entry for the purposes of administering the Prize Draw only and no personal data shall be used for direct marketing (unless an Entrant has separately opted-in to direct marketing). Where a Winner's personal data (including their name, email address, contact number, delivery address and, where applicable, favourite Premier League club) is shared with the Administrator for the purposes of Prize fulfilment, such data shall be shared in accordance with applicable data protection legislation and the Administrator shall process such data solely for the purpose of fulfilling the Prize. 14. This clause 14 shall be read in conjunction with the Creative Moment of the Month rules/instructions. You acknowledge and agree that all rights in and to any Premier League images and/or other Premier League assets provided to you in connection with the Prize Draw are the sole property of the Premier League. By submitting an Entry, a Winner acknowledges and agrees that the PL and the Administrator may make available and distribute any element of their Entry throughout the world in any media now known or hereafter invented, including any accompanying photographs of the Winner with the Prize. For the avoidance of doubt, the PL may make use of a Winner’s entry, their proper name and country of residence online and in print, or in any other media, in connection with the Prize Draw, without payment or compensation, except where prohibited by law.

15. The PL and the Administrator shall not be liable or responsible for errors in the administration or fulfilment of the Prize Draw, including without limitation mechanical, technical human, printing, distribution or production errors. In addition to clause 12, the PL and the Administrator shall not be liable for any failure to deliver the Prize to a Winner provided the PL and/or the Administrator has taken reasonable steps to complete such delivery. In this regard, Entrants acknowledge and accept that there are certain territories in which delivery of prizes by the Administrator may not be practicable. The PL and Administrator shall be ultimately responsible for determining eligibility, in its sole discretion.

16. The Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Prize Draw, or use or redemption of prize. For the avoidance of doubt, the PL and the Administrator cannot accept any liability to any Entrant for any of the following types of loss which an Entrant may suffer as a result of their Entry.

a. loss which was not foreseeable to an Entrant and the PL when the Entrant first entered any of the Prize Draw, (even if that loss results from the PL’s and/or the Administrator’s failure to comply with these terms and conditions or its negligence);

b. any business loss an Entrant may suffer, including loss of revenue, profits, or anticipated savings (whether those losses are the direct or indirect result of the PL and/or the Administrator’s default); or

c. loss which an Entrant suffers other than as a result of the PL and/or the Administrator’s failure to comply with these terms and conditions (or any typographical or other error contained herein) and the PL and/or the Administrator’s negligence or breach of statutory duty.

17. Nothing in these terms will limit the PL or the Administrator’s liability for death or personal injury arising from its negligence or if the PL or the Administrator deliberately lied to Entrants before an Entry was submitted.

18. In the event of any breach by an Entrant of these terms and conditions, the PL reserves the right to:

a. refuse entry into the Prize Draw; or

b. disqualify an Entry and Entrants from the Prize Draw.

19. APPLICABLE LAWS AND JURISDICTION. This Prize Draw, and these terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

20. ANNOUNCEMENT OF WINNER. Confirmation of the Winner will be shared in due course once the Winner has formally accepted the Prize. Any request for further information should be made by via the Entrant’s account. Parent/guardian consent is required prior to any such announcement relating to a Winner under the age of eighteen (18).
